1. Introduction
These terms govern your use of Burvo's website and the text messaging programs described below. Section Co. operates Burvo and is referred to as “we,” “us,” or “our” in these terms. Please read these terms carefully. Agreeing to these terms or using our website does not, by itself, enroll you in text messages.
2. Intellectual Property Rights
Under these Terms, Burvo and/or its licensors own all the intellectual property rights and materials contained in this website, except for any third-party trademarks or copyrighted materials that may be referenced. These are the property of their respective owners and are used by Burvo under license or for identification and reference purposes only.
3. Restrictions
You are specifically restricted from all of the following:
- publishing any website material in any other media;
- selling, sublicensing, and/or otherwise commercializing any website material;
- publicly performing and/or showing any website material;
- using this website in any way that is or may be damaging to this website;
- using this website in any way that impacts user access to this website;
- using this website contrary to applicable laws and regulations, or in any way may cause harm to the website, or to any person or business entity;
- engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to this website.
4. Content Contribution
All content posted on this website is created and posted by employees of Section Co. Unauthorized use and/or duplication of this material without express and written permission from Section Co. is strictly prohibited.
5. No warranties
This website is provided "as is," with all faults, and Section Co. expresses no representations or warranties, of any kind related to this website or the materials contained on this website.
6. Limitation of liability
In no event shall Section Co., nor any of its officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of this website whether such liability is under contract. Section Co., including its officers, directors, and employees shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this website.
7. Indemnification
You hereby indemnify to the fullest extent Section Co. from and against any and/or all liabilities, costs, demands, causes of action, damages, and expenses arising in any way related to your breach of any of the provisions of these Terms.
8. Severability
If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
9. Variation of Terms
We may revise these terms and will post the revised version with an updated date. We will provide additional notice or obtain consent when required by law. Changes to these terms do not expand the scope of your SMS consent or enroll you in a new messaging program.
10. Assignment
Section Co. is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these terms.
11. Entire Agreement
These terms govern your use of this website and our text messaging programs. They do not replace a separate agreement for professional services. Any specific SMS enrollment disclosures also apply to the messaging program you choose.
12. Governing Law & Jurisdiction
These Terms will be governed by and interpreted in accordance with the laws of the State of Colorado. Any dispute arising out of or relating to these Terms must be brought exclusively in the state courts located in Boulder County, Colorado, or, if federal subject-matter jurisdiction exists, in the United States District Court for the District of Colorado. Each party consents to the personal jurisdiction and venue of those courts.
13. Text Messaging Terms
Burvo offers text messaging for the purposes below. Messages may be sent using automated technology. You must be the subscriber or authorized user of the mobile number you provide. Please notify us if your number changes or you no longer control it.
- Verification: When you request a verification code, you consent to receive an SMS code at the number you provide, including additional codes you request. The number of messages depends on your requests. This does not enroll you in service updates or marketing texts.
- Customer conversations: When you text us with an inquiry, we may reply about that inquiry. A conversation does not enroll you in recurring updates or marketing texts.
- Service and project updates: If you separately opt in, we may send messages about your services, project status, appointments, or related coordination. Frequency varies with your project and interactions.
- Marketing: If you separately provide express written consent, we may send recurring promotional texts about Burvo's services, offers, news, and events. Message frequency varies. Marketing consent is optional and is not a condition of purchasing any goods or services, requesting information, or verifying your phone number.
Charges and delivery: Standard message and data rates may apply. Delivery depends on your carrier and network availability and is not guaranteed. Carriers are not liable for delayed or undelivered messages. Text messaging is not an emergency service.
Opting out: Reply STOP to the number that sent the message to stop receiving texts from that sender. You may also contact [email protected] to withdraw consent or make another clear request to stop. We honor reasonable opt-out requests; you do not have to use a particular keyword or method. You may receive one non-promotional confirmation of your opt-out. We will not resume messages covered by your request unless you provide new consent. Opting out may prevent delivery of verification codes or service updates by text; contact us for assistance. Opting out of marketing does not cancel your purchased services.
Help: Email [email protected] for assistance. Do not send passwords, payment details, or other sensitive information by text, and do not share verification codes.
Privacy: Our Privacy Policy explains how we handle mobile numbers, messages, and consent records. Your SMS consent applies only to the purposes you selected and is not transferable to another sender.
